  • 11.1 These Terms & Conditions constitute the salient terms applicable to the Credit Union website. They do not comprise an exhaustive list and must be read in conjunction with and subject to the Credit Union Act and other relevant law.
  • 12.0 Identification

  • 12.1 To ensure compliance with the Criminal Justice Act, 1994 (as amended from time to time) the Accountholder will be required to produce to the Credit Union satisfactory evidence of identity, current permanent address and possibly source of funds by means of supporting documentation.
  • 13.0 Amendment to Terms & Conditions

  • 13.1 The Credit Union reserves the Right to vary these terms & conditions if there is any relevant material change in the prevailing legal, tax or regulatory conditions or to enhance the security of the services provided by the Credit Union.
  • 13.2 The Credit Union reserves the right at all times to introduce new conditions or to vary or amend existing conditions by giving at least fourteen days notice thereof to the Accountholder, by whatever means deemed appropriate by the Credit Union which could include a notice display in the Credit Union Offices.
  • Coolock Artane Credit Union Limited is regulated by the Financial Regulator.
  • 1.0 Definitions

  • 1.1 The Loan Account is referred to in these terms & conditions as the Term Loan Account.
  • 1.2 The member(s) in whose name(s) the Term Loan Account is opened is referred to as the "Accountholder" which reference shall include the plural, where appropriate.
  • 1.3 "Credit Union" means Coolock Artane Credit Union.
  • 1.4 A Term Loan Account is an advance, granted by the Credit Union for a specific purpose, repayable by agreed amount(s) within a fixed period
  • 2.0 Loan Application and approval

  • 2.1 Subject to the following Terms & Conditions, the Credit Union may agree to provide a Term Loan Account in the name of the Accountholder.
  • 2.2 All loan applications, inter alia are subject to checks in regard to repayment capacity, status and previous loan repayment record.
  • 2.3 The Credit Union reserves the right to make "searches" about each loan applicant in regard to Credit Reference agencies, the electoral register and Judgement Register. "For your as well as our protection, the credit union may use your personal information from time to time to develop behavioural credit scoring models/techniques for the purposes of credit limit and risk management which may entail disclosure of your information to our external service providers who will assist us in developing these models"
  • 2.4 All loan applications must be signed by the member.
  • 2.5 Accountholder's who have been granted a Term Loan have "cancellation rights". The ten day "cooling-off" period allows the Accountholder to change their mind about taking out the loan.
  • 2.6 Unless otherwise agreed, drawdown of the loan, must take place on the date or dates set out on the front page of the Credit agreement.
  • 3.0 Repayment

  • 3.1 The Accountholder covenants to repay the loan and to pay interest thereon. Unless otherwise agreed, Term Loans are subject to regular repayments (weekly, fortnightly and monthly) by way of equal instalments with the aim of repaying principal and interest over the term of the borrowing. The amount of the agreed repayment is established at loan application stage, in light of the term, frequency of instalments and interest rate prevailing at the time the Term Loan is granted.
  • 3.2 For specific Term Loans, at the discretion of the Credit Union, lump sum repayments of principal and interest may be acceptable by way of staged repayments or one "bullet" repayment at the end of the loan period
  • 3.3 Subsequent variations in the repayment of the loan may be accommodated at the discretion of the Credit Union by way of:
    • (a) An adjustment in the term of the loan.
    • (b) An adjustment in the number of repayments.
    • (c) A revision of the amount of the regular repayments during the period of the Term Loan.
  • 3.4 Repayments in excess of those agreed may be made at any time during the term of the loan without penalty.
  • 3.5 The Accountholder may, by giving notice to the Credit Union, repay the loan in full at any time during the period of the loan without any additional cost.
  • 4.0 Interest Rate/APR and Amendment of same.

  • 4.1 The Interest Rate, which is subject to variation during the period of lending, is determined by the Board of the Credit Union. Notice of a change in the Lending rate will be by way of notice in the Credit Union offices, Credit Union Newsletter, Credit Union Statement and Credit Union Website.
  • 4.2 Interest is calculated on the Term Loan Account on a daily basis on the balance outstanding at the end of the day.
  • 4.3 APR is short for Annual Percentage Rate and is quoted on all loan documentation. The calculation of the APR is the standard way of working out the true interest rate taking into account the timing of the repayments and all other charges that you may have to pay in relation to a loan drawdown. It is an accurate way of comparing loan quotations, other than on interest rate alone.
  • 4.4 The APR specified in the Credit Union Loan Agreement is that rate, on an annual basis that equalises the present value of all commitments (loans, repayments and charges), future or existing, agreed by the Credit Union and the member concerned, calculated in accordance with the mathematical formula set out in Annex 2 to the European Communities (Consumer Credit) Regulations 2000 as in force from time to time.
  • 4.5 The APR is as stated in the Important Information summary in the Credit Agreement and subject to change in accordance with section 4.6 below.
  • 4.6 The APR may change from time to time subject to market conditions and in accordance with 4.1 above, and, for example, in the following circumstances:
    • (a) If the interest rate changes during the Term of the Credit Agreement or between the date of the Credit Agreement and the date of drawdown.
    • (b) If the drawdown date differs from the date of the APR calculation.
    • (c) If the interval by which the interest is charged changes.
  • 5.0 Security

  • 5.1 Any Security held by the Credit Union in relation to a Loan Account shall be held as security for all liabilities in relation to the Accountholder.
  • 5.2 In the event of two or more members constituting the Accountholder, the liability of such members will be joint and several.
  • 6.0 Maintenance of Account

  • 6.1. If an Accountholder fails to pay a Loan instalment or fails to perform or observe any of the terms and conditions of the Loan agreement or if any information provided by the Accountholder is incorrect, incomplete, inaccurate or untrue, the Credit Union may serve the Accountholder with a notice of default and "call in" the loan.
  • 6.2 In the event of:
    • (a) any repayment of principal or payment of interest in respect of the loan, not being made on the due date or,
    • (b) any breach by the Accountholder in regard to obligations of the Accountholder to the Credit Union.
    • (c) the death, bankruptcy or contractual incapacity of any guarantor or if any guarantee should become enforceable, the Credit Union may, subject to and in accordance with the provisions of the Credit Union Act 1997 (as amended) and the Rules of the Credit Union, terminate the Credit agreement and call in the Loan, together with interest.
  • 6.3 If an Accountholder continues to default on Loan instalments, without the permission of the Credit Union, the Accountholder may be subject to Legal Action by the Credit Union to recover the debt due, including interest.
  • 6.4 The Credit Union reserves the right to make a charge:
    • (a) For any "collection" activity in relation to instalment arrears, including but not limited to Legal Fees, Tracing Fees, Visit to the Accountholder's last known address or any arrears letter issued.
    • (b) For loan rescheduling, adjusting, varying or altering the repayment date or the instalment amount.
    • (c) For any reversal of a Direct Debit or Cheque Payment.
  • 7.0 Payment Protection Insurance (PPI)

  • 7.1 Where the Accountholder has elected to avail of PPI, the amount of the premium will be deducted from the Accountholder's share balance, into which extra payment to cover the premium which has been agreed by the Accountholder, will be paid, in line with the agreed regular loan repayment.
  • 7.2 Where the Accountholder has elected to avail of PPI, the Accountholder authorises the Credit Union to pay the PPI premium directly to the relevant insurance company and to discharge any commission due to the Credit Union.
  • 7.3 Where the Accountholder has elected to avail of PPI, the Accountholder authorises the Credit Union to apply the whole or any part of the proceeds of any insurance claim in discharge of all or any part of the monies payable by the member on the agreed loan repayments.
  • 8.0 Statement of Account
  • 8.1 The Credit Union undertakes to post a Statement of Account on a yearly basis. However, a Statement can be obtained at any time by the Accountholder by requesting same at the Credit Union Offices. The Accountholder undertakes to check this statement and ensure that the balance/ transaction and interest rate noted on the Statement are correct and in agreement with the Accountholder's passbook. The Accountholder will further undertake to notify the Credit Union immediately of any error noted on the Statement.
  • 9.0 Interpretation

  • 10.0 Identification

  • 12.0 Authority

  • 12.1 The Credit Union is authorised by the Accountholder(s) to disclose information relating to the Loan Account or any information in relation to security held in relation to the Loan Account to any person acting as agent or to other third parties engaged by the Credit Union in connection with the Loan Account.
  • 13.0 Termination

  • 13.1 The Loan is immediately repayable in the event of the bankruptcy, death, or contractual incapacity of the Accountholder in accordance with the Credit Union Act 1997 and the Rules of the Credit Union
  • 13.2 At maturity/repayment of the Term Loan Account, this agreement will cease.
  • 13.3 On termination, the Accountholder must pay the Credit Union the outstanding balance and interest due and payable up to the date of termination including, if necessary, any interest due on late repayments.
